I. STORE REGULATIONS – GENERAL PROVISIONS
- The online store operating at www.itripcomputer.com is run by SPARK ELECTRONICS Ltd., with its registered office in Warsaw at Aleja Prymasa Tysiąclecia 78A, 01-424, registered in the National Court Register (KRS) under number 0001043602, NIP 5273063002, REGON 525655329
- The Online Store www.itripcomputer.com operates on the principles defined in these Regulations.
- These Regulations are addressed to both Consumers and Entrepreneurs using the Store, and define the rules for using the online store as well as the terms and procedure for concluding Distance Sales Agreements with the Customer through the Store.
- Familiarization with, and acceptance of, these regulations and their provisions is a condition for placing an order in the online store by the Customer.
- These regulations specify both the scope and types of electronic services provided by the Online Store: https://metromierze.itripcomputer.com, and also define the rules for providing these services, the conditions for concluding and terminating sales agreements, and the complaint procedure.
- The Online Store conducts retail and wholesale sales via the Internet.
All Products offered in the Online Store are new, free from physical and legal defects, and have been legally introduced to the Polish market. - All trade names, Product names, company names, and their logos used on the Online Store’s website belong to their respective owners and are used solely for identification purposes. They may be registered trademarks. All materials, descriptions, and photos presented on the Online Store’s website are used for informational purposes.
- In matters not regulated by these Regulations, the provisions of the following shall apply: the Act on Providing Services by Electronic Means of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended); the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827), the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended), and other relevant provisions of Polish law.
II. STORE REGULATIONS – DEFINITIONS
- Business Day – any day from Monday to Friday, excluding public holidays.
- Registration Form – a form available on the website www.taniekasy.online enabling the creation of an Account.
- Order Form – a form available on the website www.taniekasy.online enabling the placement of an Order.
- Consumer – a natural person who performs a legal act with an entrepreneur that is not directly related to their business or professional activity.
- Customer – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.
- Account – a set of resources in the Service Provider’s ICT system, identified by an individual name (login) and password, where Service Recipient’s data, including information about placed Orders, are stored.
- Regulations – these regulations of the Online Store.
- Online Store – the Service Provider’s Online Store operating at www.rallytripmeter.rallycomputer.com
- Seller, Service Provider – Robert Skierski, owner of Spark Electronics Prokar.
- Product – a movable item available in the Online Store, which is the subject of a Sales Agreement between the Customer and the Seller.
- Sales Agreement – a Product Sales Agreement concluded between the Customer and the Seller through the Online Store.
- Service Recipient – a natural person, legal person, or organizational unit without legal personality, to whom the law grants legal capacity, using the Electronic Service.
- Order – a declaration of will by the Customer constituting an offer to conclude a Product Sales Agreement with the Seller.
- Shopping Cart – a software element of the Store where Products selected by the Customer for purchase are visible, and where it is possible to define and modify Order details, particularly the quantity of products.
- Entrepreneur – a natural person, legal person, and organizational unit without legal personality, to whom a separate act grants legal capacity, conducting business activity on their own behalf, who uses the Store.

- The Customer may communicate with the Seller using the addresses and phone numbers provided in this paragraph.
- The Customer may contact the Seller by phone from Monday to Friday between 8:00 AM and 4:00 PM.
IV. TYPE AND SCOPE OF ELECTRONIC SERVICES
- The Service Provider enables the use of Electronic Services through the Online Store, such as:
– concluding Sales Agreements via the Order Form,
– maintaining an Account in the Online Store. - The provision of Electronic Services to Service Recipients in the Online Store takes place under the conditions specified in the Regulations.
- The Service Provider has the right to place advertising content on the Online Store’s website. The advertising content referred to in the preceding sentence constitutes an integral part of the Online Store and the materials presented therein.
- The Service Recipient, when using the Online Store, under the rules specified in the Regulations and generally applicable legal provisions, has the right to express an opinion on Products offered for sale in the Online Store.
- The Service Provider reserves the right not to publish all or part of an opinion. In particular, opinions containing vulgarisms (Article 3 of the Act on the Polish Language of October 7, 1999); offending persons, nationalities, religions (Article 23 of the Civil Code and Articles 194 – 196 of the Penal Code); containing unverified information or unsubstantiated accusations against other persons (Article 23 of the Civil Code) will not be published. Opinions containing links to private websites www.taniekasy.online, containing personal data, contact details, or email addresses, or containing remarks addressed to store staff will not be published. An opinion sent multiple times will only be published once.
- The Service Recipient undertaking such actions shall be solely responsible for the consequences of their actions involving the posting of opinions in the Online Store.
- By using the Online Store and posting opinions or any other content, the Service Recipient warrants that they possess all rights in this regard, including, in particular, proprietary copyrights, that their actions do not infringe upon the rights of third parties, and that they are authorized to undertake such actions.
V. CONDITIONS FOR PROVIDING AND CONCLUDING AGREEMENTS FOR THE PROVISION OF ELECTRONIC SERVICES
- The provision of Electronic Services specified in Chapter III, Section 1 of the Regulations by the Service Provider is free of charge.
- Term of the agreement:
– The agreement for the provision of the Electronic Service consisting of enabling the placement of an Order in the Online Store by filling out the Order Form is concluded for a definite period and terminates upon the placement of the Order or the Service Recipient ceasing to place it.
– The agreement for the provision of the Electronic Service consisting of maintaining an Account in the Online Store is concluded for an indefinite period. - Technical requirements necessary for cooperation with the ICT system used by the Service Provider:
– A computer with Internet access.
– Access to email.
– A web browser. - The Service Recipient is obliged to use the Online Store in a manner consistent with the law and good customs, and with due regard for the personal rights and intellectual property rights of third parties.
- The Service Recipient is obliged to enter data consistent with the actual state of affairs.
- The Service Recipient is prohibited from providing unlawful content.
VI. CONDITIONS FOR CONCLUDING SALES AGREEMENTS
- Information found on the Online Store’s website www.taniekasy.online does not constitute an offer within the meaning of legal provisions.
- By placing an Order, the Customer makes an offer to purchase a specific Product under the conditions provided in its description.
- In the event of unavailability of some or all Products included in an Order, the Customer is informed by email or phone. They are asked to make a decision regarding the further processing of the order (cancellation, fulfillment without missing Products, longer waiting time for fulfillment, selection of another Product).
- The Product price displayed on the Online Store’s website is given in Polish zlotys (PLN) and does not include VAT, customs duties, or any other components. The price also does not include Product delivery costs.
- The Product price displayed on the Online Store’s website is binding at the moment the Customer places an Order. This price will not change regardless of price changes in the Online Store that may occur for individual Products after the Customer has placed an Order.
- Promotional Products have a limited number of units, and Orders for them will be fulfilled in the order they are received until the stock of a given Product is exhausted.
- To place an Order, the Customer is required to register an Account in the Online Store.
- Orders can be placed:
– via the website using the Order Form (Online Store) – 24 hours a day, all year round.
– via email to: biuro@sparkelectronics.pl
– by phone at: 22 8362451 - Conclusion of the Sales Agreement.
– To conclude a Sales Agreement, the Customer must first place an Order.
– After an Order is placed, the Seller immediately confirms its receipt, which binds the Customer to their Order and simultaneously accepts the Order for fulfillment. - Confirmation of Order receipt occurs by sending an email containing:
– the Seller’s statement of Order receipt,
– confirmation of all essential elements of the Order,
– these Regulations,
– a statement regarding the right to withdraw from the agreement,
– instructions on the right to withdraw from a distance contract. - If a placed Order requires modification, the Online Store sends the Customer an email containing the modified Order. This allows the Customer to decide on the further processing of the Order.
Upon the Customer’s receipt of the email, or upon the Customer’s confirmation of the modified Order, a Sales Agreement is concluded between the Customer and the Seller. - Orders placed on weekdays after 5:00 PM, on Saturdays, Sundays, and holidays will be processed on the next Business Day.
- Each Sales Agreement will be confirmed by a VAT invoice, which will be attached to the shipment.
VII. STORE REGULATIONS – PAYMENT METHODS
- The Seller offers the following payment methods:
– Payment on delivery (cash on delivery) .
– Payment by traditional bank transfer to the Seller’s bank account

In the transfer title, please enter “Order no. …”.
– Payment upon personal collection.
– Payment via PayU.pl service. - The Customer is obliged to pay the price under the Sales Agreement within 7 days from the date of its conclusion, unless the Sales Agreement states otherwise.
- In the case of payment by bank transfer, the Product is shipped after the payment is credited to the Seller’s bank account.
- In the case of payment on delivery, the shipment is dispatched after verification of the correctness of the address details.
- In the case of payment via PayU.pl service, the Customer makes the payment before the Order fulfillment begins. The PayU.pl service allows payment by credit card or fast bank transfer from selected Polish banks. The Product will only be shipped after it has been paid for.
- The Online Store enables Customers to purchase Products through leasing and on the basis of trade credit. These conditions are determined based on individual arrangements with the Customer.
VIII. COST, DELIVERY TIME, AND METHODS
- Product delivery costs are determined during the Order placement process. They depend on the chosen payment method and the delivery method of the purchased Product.
- Products purchased in the Online Store are shipped via a courier company or by the Seller’s own transport.
- The Customer may personally collect the Product at: Aleja Prymasa Tysiąclecia 78A, 01-424 Warsaw.
- The Product delivery time consists of the Product preparation time and the Product delivery time by the carrier:
– Product preparation time is up to 3 Business Days.
– Product delivery by the carrier takes place within the 5 Business Days declared by the carrier.
IX. STORE REGULATIONS – PRODUCT WARRANTY
- All Products come with a manufacturer’s or seller’s warranty, valid within the territory of the Republic of Poland.
The manufacturer’s warranty period for Products offered by the Online Store is 12 months and is counted from the date the Product is delivered to the Customer.
X. PROMOTIONAL OFFERS AND DISCOUNT CODES
- Promotional offers and discount codes described in this chapter apply exclusively to Products in the Online Store www.itripcomputer.com.
- Promotional offers and discount codes available in the Online Store are not cumulative. The Customer’s use of a discount code prevents them from taking advantage of a price discount resulting from a promotional offer.
- Products covered by a promotional offer are available to all Customers. The price discount resulting from the promotional offer is included in the Product price at the time the Customer places an Order.
- Discount codes:
– Discount codes are granted to the Customer of the Online Store www.taniekasy.online by the Online Store’s staff.
– Discount codes can be redeemed during the Order placement process. - To redeem a discount code, please enter the discount code number in the appropriate field of the Order Form and confirm with the button next to that field.
XI. COMPLAINT PROCEDURE
- Complaints regarding Product non-conformity with the Sales Agreement:
The grounds and scope of the Seller’s liability towards a Customer who is a Consumer, due to Product non-conformity with the Sales Agreement, are specified, in particular, by the Act on special conditions of consumer sales and on amendment to the Civil Code of July 27, 2002 (Journal of Laws No. 141, item 1176, as amended). - Notifications of Product non-conformity with the Sales Agreement and submission of a corresponding claim can be made via email to: biuro@sparkelectronics.pl or in writing to: SPARK ELECTRONICS Ltd., Al. Prymasa Tysiąclecia 78A, 01-424 Warsaw. If it is necessary for assessing the Product’s non-conformity with the agreement, it should be delivered to: SPARK ELECTRONICS Ltd., Al. Prymasa Tysiąclecia 78A, 01-424 Warsaw.
- The Seller will respond to the Customer’s request promptly, no later than within 14 days. The response regarding the complaint is sent to the email address provided by the Customer or by another method specified by the Customer.
- Complaints related to the provision of Electronic Services through the Online Store can be submitted by the Service Recipient via email to: info@itripcomputer.com. In the aforementioned email, as much information and as many circumstances as possible regarding the subject of the complaint should be provided, in particular, the type and date of the irregularity, and contact details. The provided information will significantly facilitate and expedite the Service Provider’s handling of the complaint.
- Detailed information regarding the Consumer’s possibility to use out-of-court methods for resolving complaints and pursuing claims, as well as the rules for accessing these procedures, are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and at the following internet addresses of the Office of Competition and Consumer Protection:

XII. RIGHT OF WITHDRAWAL FROM THE AGREEMENT
- A Customer who is also a Consumer and has concluded a distance contract may withdraw from it without giving reasons by submitting a written statement within 14 days. To meet this deadline, it is sufficient to send the statement of withdrawal or include it with the returned Product.
- In the event of withdrawal from the contract, the Sales Agreement is considered void, and the Consumer is released from all obligations. What the parties have provided shall be returned in an unchanged state, unless the change was necessary within the scope of ordinary use. The return should occur immediately, no later than within 14 days.
- The Seller shall refund the value of the Product along with its delivery costs using the same payment method as used by the Consumer, unless the Consumer has expressly agreed to a different refund method that does not incur any costs for them.
- If the Consumer has chosen a Product delivery method other than the cheapest standard delivery method offered by the Online Store, the Seller is not obliged to refund the Consumer for the additional costs incurred.
- A Consumer withdrawing from the Sales Agreement, in accordance with point 1 of this chapter, shall bear only the costs of returning the Product to the Seller.
The fourteen-day period during which the Consumer may withdraw from the contract is counted from the day the Consumer took possession of the Product.
XIII. STORE REGULATIONS – COOKIES
- The Service Provider’s Online Store uses “cookies”. No change to the browser settings by the Service Recipient (Customer) is equivalent to consenting to their use.
- The installation of “cookies” is necessary for the proper provision of services in the Online Store. “Cookies” contain information essential for the proper functioning of the Online Store, especially those requiring authorization.
- The content of “cookies” does not allow for the identification of the Service Recipient (Customer). Personal data is not processed or stored using “cookies”.
XIV. FINAL PROVISIONS
- Agreements concluded via the Online Store are governed by Polish law.
- Changes made to the Online Store Regulations by the Service Provider are binding on the Service Recipient, provided that they have been properly informed of the changes and had the opportunity to review them.
- None of the provisions of these Regulations aims to violate the rights of the Service Recipient. In the event of any inconsistency between any part of the Regulations and applicable law, the Service Provider declares its unconditional compliance with and application of that law in place of the challenged provision of the Regulations.
- Any disputes arising from Sales Agreements between the Online Store and Consumers will be resolved primarily through negotiation, with the intention of amicable settlement. However, if this is not possible or would be unsatisfactory for either party, disputes will be resolved by the competent common court.
