Complaints and returns on account of non-compliance of the Product with the Sales Agreement
(1) Complaints and returns are the basis and scope of the Seller’s liability to the Customer who is a Consumer, for non-compliance of the Product with the Sales Agreement, are defined in particular by the Act on Special Terms of Consumer Sales and Amendments to the Civil Code of July 27, 2002. (Journal of Laws No. 141, item 1176, as amended).
2. Notification of non-conformity of the Product with the Sales Agreement and submission of the relevant request may be submitted via e-mail to : info@itripcomputer.com or in writing to the address: SPARK ELECTRONICS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw at Aleja Prymasa Tysiąclecia 78A, 01-424.
3. When it is necessary to assess the nonconformity of the Product with the contract, it should be delivered to the address: SPARK ELECTRONICS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ based in Warsaw at Aleja Prymasa Tysiąclecia 78A, 01-424.
4. The Seller shall respond to the Customer’s request immediately, no later than within 14 days. In connection with the defect, you may demand:
– Replacement of the item with a defect-free one,
– removal of the defect,
or make a statement about:
– price reduction,
– withdrawal from the contract – in case of a material defect.
We are liable to the customer for defects found before the expiration of two years from the date of delivery of the item.
As a general rule, a complaint can be filed within a year of noticing the defect, but the time for filing a claim cannot end before the expiration of the seller’s liability period.
(5) The response to the complaint shall be sent to the e-mail address provided by the Customer or in any other manner provided by the Customer.
(6) Complaints related to the provision of Electronic Services through the Online Store, the Customer may submit via e-mail to the address: info@itripcomputer.com.
In the above email, provide as much information and circumstances as possible about the subject of the complaint, in particular the type and date of the irregularity and contact information. The information provided will greatly facilitate and expedite the processing of the complaint by the Service Provider.
Returns
(1) A customer who is also a Consumer, who has entered into a remote contract, may withdraw from it without giving reasons by submitting an appropriate statement in writing within 14 days. To meet this deadline, it is sufficient to send a statement of withdrawal to the Seller’s email address: info@itripcomputer.com or attach it to the package with the returned Product.
2. In the event of withdrawal from the contract, the Sales Contract is considered not concluded and the Consumer is released from all obligations. What the parties have rendered shall be returned unchanged, unless the change was necessary within the limits of ordinary management. The return should be made immediately, but no later than within 14 days.
3. The Seller will refund the value of the Product plus the cost of delivery using the same method of payment used by the Consumer. Unless the Consumer has expressly agreed to another way of return, which does not involve any costs for the Consumer.
4. If the Consumer has chosen a method of delivery of the Product other than the cheapest ordinary method of delivery offered by the Online Shop, therefore the Seller is not obliged to reimburse the Consumer for any additional costs incurred by the Consumer.
5. The Consumer withdrawing from the Sales Agreement, in accordance with point. 1 of this chapter, shall bear only the costs of returning the Product to the Seller.
6. The fourteen-day period in which the Consumer may withdraw from the contract shall be counted from the day on which the Consumer took possession of the Product.
