I. GENERAL PROVISIONS

Prymasa Tysiąclecia 78A is SPARK ELECTRONICS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered in the National Court Register 0001043602, NIP 5273063002, REGON 525655329, e-mail address: biuro@sparkelectronics.pl hereinafter referred to as the “Administrator” and being both the Seller and the Service Provider.
  2. The Buyer’s and Customer’s personal data are processed in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883, as amended) and the Act on Providing Electronic Services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended).
  3. The controller shall exercise special care to protect the interests of data subjects, and in particular shall ensure that the data it collects are processed lawfully; collected for specified, legitimate purposes and not subjected to further processing incompatible with those purposes; substantively correct and adequate in relation to the purposes for which they are processed; and stored in a form that allows the identification of data subjects for no longer than is necessary to achieve the purpose of the processing.
  4. Any words or expressions capitalized in the body of this Privacy Policy shall be understood as defined in the Terms and Conditions of the Online Store.

II. PURPOSE AND SCOPE OF DATA COLLECTION

  1. Personal data of Buyers and Service Recipients, collected by the Administrator, are used for accounting purposes, marketing purposes, contacting the Customer and other activities related to the execution of the Sales Agreement.
  2. The Administrator processes the following personal data of Service Recipients:
    • Name, company name,
    • Address (street and house/apartment number, postal code, city),
    • Phone number,
    • Tax ID number,
    • Email address.
  3. The Administrator may process the following data characterizing how the Customer uses the services provided electronically (exploitation data):
    • Designations identifying the telecommunications network termination or data communications system used by the Customer.
    • Information about the beginning, end and scope of each time the Customer uses the
      service provided electronically.
    • Information about the use of electronically provided services by the Customer.
  4. Provision of personal data referred to in paragraph 2 is necessary for the Service Provider to provide services electronically through the Online Store or to conclude a Product Sales Agreement.

III. PRIVACY POLICY – BASIS OF DATA PROCESSING

  1. The use of the Online Store, conclusion of agreements for the provision of services by electronic means through the Online Store or conclusion of Contracts for Sale of Products, which involves the necessity of providing personal data, is completely voluntary. The data subject decides on his/her own whether he/she wants to start using the services provided electronically by the Service Provider or conclude a Product Sales Contract in accordance with the Regulations of the Internet Shop.
  2. Pursuant to Article 23 of the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883, as amended), data processing is permitted when, among other things:
    • the data subject consents to this, unless it is a matter of deleting data concerning him.
    • it is necessary for the performance of a contract when the data subject is a party to it, or when it is necessary to take action prior to entering into a contract at the request of the data subject.
  3. The processing of personal data by the Administrator shall always be carried out within the framework of the grounds of permissibility of processing listed in paragraph (2). 2. The processing of the data will be related to the performance of the contract or the need to take action prior to the conclusion of the contract at the request of the data subject (paragraph 2(b)). In addition, prior to the conclusion of contracts for the provision of electronic services available through the Online Store, the prospective Customer is informed of the need to accept the Terms and Conditions.

IV. THE RIGHT TO CONTROL, ACCESS AND CORRECTION OF YOUR DATA

  1. The customer has the right to access and correct the content of his personal data.
  2. Every person has the right to control the processing of data concerning him/her contained in the Administrator’s data filing system, and in particular the right to demand that personal data be supplemented, updated, rectified, temporarily or permanently suspended or erased if they are incomplete, outdated, untrue or have been collected in violation of the law, or are no longer necessary for the purpose for which they were collected.

VII. FINAL PROVISIONS

  1. The Administrator shall apply technical and organizational measures to ensure the protection of the processed personal data appropriate to the risks and categories of protected data, and in particular shall protect the data from being accessed by unauthorized persons, from being taken by an unauthorized person, from being processed in violation of applicable regulations, and from being altered, lost, damaged or destroyed.
  2. The Service Provider provides the following technical measures to prevent unauthorized persons from obtaining and modifying, personal data sent electronically:
    • Encryption of data used to authorize the Service Recipient.
    • Securing the data set against unauthorized access.
  3. In matters not regulated by this Privacy Policy, the provisions of the Regulations of the Internet Store and other relevant provisions of Polish law shall apply accordingly.
